DECATUR, GA -- DeKalb District Attorney Robert James made a brief statement Tuesday morning, saying that accused Dunwoody gunman Hemy Neuman had been charged with the murder of Rusty Sneiderman.

James said that indictment paperwork was being filed in the case Tuesday morning, charging Neuman with one count of malice murder and one count of possession of a firearm during the commission of a felony.

He answered a few questions after reading the brief statement, but said that he would not be able to reveal any specific details about the prosecution's case as filed. James insisted the case would not be tried in the media.

The statement was released as follows:


Good morning,

During the course of the last four weeks, my office began to work with the Dunwoody Police Department to investigate the death of Mr. Russell Sneiderman. Since Mr. Sneiderman's death in November of last year, the Dunwoody Police and my investigators have worked tirelessly to bring justice to the loved ones of Mr. Russell Sneiderman and the citizens of DeKalb County.

Today, at 9 a.m. the DeKalb County Grand Jury returned a two-count indictment of Hemy Neuman.

That indictment is currently being filed with the DeKalb County Clerk of Superior Court

Neuman was indicted by the Grand Jury for 1 count of malice murder and 1 count of possession of a firearm during a commission of a felony.

Our collective goal is to continue to seek justice and preserve the public safety of our community, not only for the Sneiderman Family but for anyone who has lost a loved one because of violent crime.

We will not try this case in the media nor will discuss the evidence that will be presented at trial.

Our job is to present the facts, the truth and to seek justice.

As many of you know, procedurally, an Arraignment Calendar is the next step...and if the defendant does not plead guilty at the arraignment calendar, then it would be bound over to a trial calendar....my Chief Assistant DA Don Geary and I are prepared to move forward with a trial...

Again, to ensure the integrity of this case, I will be unable to answer any questions from the media as it pertains to the evidence.

Neuman is accused of murder in the shooting death of Sneiderman outside a daycare in Dunwoody.

The preliminary hearing for Neuman originally scheduled for Tuesday morning was abruptly cancelled late Monday.

A major mystery surrounding the case remains the reason that Sneiderman was gunned down.

Neuman was arrested by Dunwoody police and charged with the murder of Sneiderman in early January. Neuman was a supervisor at GE Energy. Sneiderman's wife Andrea worked for Neuman.

Some of the answers and lines potentially connecting the dots in the case had been expected to be revealed at the preliminary hearing.

A statement from Andrea Sneiderman was released Tuesday afternoon.

The murder of my husband, Rusty Sneiderman, has been devastating to me and our families. I was thankful and relieved when the police made an arrest but I was shocked to learn that the man charged with the murder, was my former boss, a person who we thought was a friend of our family.

I have been assured by the DeKalb County District Attorney's Office that Mr. Neuman is Rusty's killer and that they will do everything in their power to bring him to justice. My family and I are cooperating in any way we can to assist them in their efforts.
